On September 30, 2021, the Honorable Lydia Kay Griggsby of the United States District Court for the District of Maryland denied in part and granted in part Defendants’ motion to dismiss this class action alleging price-fixing and kickback scheme to inflate the prices of single call collect calls placed by inmates from correctional facilities located within the United States, among defendants Global Tel* Link Corp. (“GTL”), Securus Technologies, LLC (“Securus”) and 3Cinteractive Corp. (“3Ci”) in violation of the Sherman Antitrust Act and the Racketeer Influenced and Corrupt Organizations Act (“RICO”).

Amazon Flex Driver Arbitrations (AAA): Cohen Milstein represents thousands of current and former Amazon Flex delivery drivers in California, Illinois and Massachusetts who allege that Amazon misclassified them as independent contractors instead of employees to avoid paying them overtime or reimbursing for expenses, and to deny them other benefits under these states’ laws. These cases are currently being litigated before the American Arbitration Association.
AMPAM Parks Mechanical ESOP Litigation
Barrios, et al. v. AMPAM Parks Mechanical, Inc., et al. (S.D. Cal.): Cohen Milstein represents employee participants and beneficiaries of the AMPAM Parks Mechanical, Inc. Employee Stock Ownership Plan in a class action lawsuit alleging that AMPAM Parks Mechanical and the founders of AMPAM, Buddy Parks, John D. Parks, James Parks, and Jason Parks breached their fiduciary duties in the management of the ESOP in violation of ERISA.

Ariza v. Luxottica Retail North America (LensCrafters) (E.D.N.Y.): Cohen Milstein, as lead counsel, represents a certified class of purchasers of LensCrafters’ Accufit Digital Measurement System (Accufit) services, who allege that LensCrafters used false, misleading advertising and deceptive sales practices about Accufit being “five times more accurate” in measuring pupillary distance than traditional methods, to induce customers to purchase LensCrafter’s higher-priced prescription lens products.

AT&T Pension Benefit Plan Litigation (N.D. Cal.): Cohen Milstein represents participants and beneficiaries in the AT&T Pension Benefit Plan who allege that AT&T failed comply with ERISA’s actuarial equivalence requirements when providing married participants joint and survivor annuities.
Bains, et al. v. American Tactical, Inc.
Bains, et al. v. American Tactical, Inc., et al. (W.D.N.Y.): On April 13, 2023, Cohen Milstein and Brady Center to Prevent Gun Violence filed a negligence, public nuisance and unlawful marketing lawsuit against American Tactical, Inc. and others involved in the manufacturing, marketing, and sale of the 60-round high-capacity magazine (HCM) used by the perpetrator in a deadly mass shooting on April 15, 2021 at a FedEx Ground Package facility in Indianapolis, Indiana. Tragically, thirteen people were shot during the attack. Eight died. At least five other people were injured.
Bains, et al. v. Securitas Security Services, USA, Inc.
Bains, et al. v. Securitas Security Services, USA, Inc. (S.D. Ind.): On April 13, 2023, Cohen Milstein filed a personal injury and wrongful death lawsuit against Securitas Security Services, USA, Inc. (Securitas) for its role in the deadly mass shooting that occurred on April 15, 2021 at the FedEx Ground Package facility on Mirabel Road in Indianapolis, Indiana. Securitas provided security guard services to the FedEx Ground facility.
Baus, et al. v. Ford Motor Company
Baus, et al. v. Ford Motor Company (E.D. Mich.): Cohen Milstein represents plaintiffs who purchased or leased vehicles manufactured by Ford Motor Company in a consolidated breach of warranty and deceptive and fraudulent business practices class action against Ford Motor Company. Plaintiffs bring their claims under the Magnuson Moss Warranty Act and the consumer fraud statutes of their respective states, related to Ford’s manufacture and sale of defective Ford F-150 pickup trucks, Model Years 2018-2020 equipped with 5.0L engines.

Baxter, et. al. v. Church of Scientology International (M.D. Fla.): On April 28, 2022, Cohen Milstein filed a human trafficking and forced labor lawsuit against David Miscavige; Church of Scientology International; Religious Technology Center, Inc.; International Association of Scientologists Administrations, Inc.; Church of Scientology Flag Service Organization, Inc.; and Church of Scientology Flag Ship Service Organization, Inc., for violations of the United States Code Chapter 77 of Title 18 and the Trafficking Victims Protection Reauthorization Act.
