Ben Bauer Speaks on Pharmacy Benefit Management

Ben Bauer, associate in our ERISA & Employee Benefits practice, has been invited to speak at the 2026 National Insurance Symposium held by the ABA Tort & Trial Insurance Practice Section (TIPS) at the Omni Hilton Head Oceanfront Resort in Hilton Head Island, South Carolina. 

Ben’s program, “Regulators, Litigators, and Fiduciaries: the Three-Front War over (PBM) Pharmacy Benefit Management Practices” will take place at 8:45 am ET. 

Ben will identify the fiduciary responsibilities of plan sponsors and benefits committees when selecting and monitoring Pharmacy Benefit Managers (PBMs). This program will also examine new transparency requirements under the Affordable Care Act, the Consolidated Appropriations Act, and Department of Labor’s Proposed Pharmacy Benefit Manager Fee Disclosure Rule, which help employers better understand PBM pricing and negotiate stronger contracts. Additionally, Ben and the other panelists will review recent litigation involving PBM selection and practical strategies to help fiduciaries reduce legal risk and defend against potential ERISA litigation.
