Quick Takes: Litigator of the Week Shout Out

Stris & Maher and Cohen Milstein Sellers & Toll get a shout out this week for scoring a Seventh Circuit ruling upholding a high-stakes trial court win concerning arbitrability in ERISA cases. Shelving and fixture company Triad Manufacturing Inc. was seeking to force plaintiff James Smith, who previously worked for the company and participated in its defined contribution plan, into arbitration. But the appellate court last week held that the plan’s arbitration provision, added since Smith left the company, “prohibits relief that ERISA expressly permits.” Peter Stris of Stris & Maher argued the appeal on behalf of Smith.
