Beef and pork plant workers seeking final approval for $200 million in wage-fixing settlements reached with major meat processors told a Colorado federal court the U.S. Department of Justice is raising concerns about conduct that stopped years ago.

The workers filed a response Wednesday to a DOJ statement of interest that urged the court to reject the settlements unless they are revised to include terms that enforcers said would prevent the meat processors from colluding on wages in the future.

The proposed class also filed a motion Wednesday seeking final approval of settlements with the processors, including Perdue Farms, Triumph Foods and Tyson Foods, and with data aggregator Agri Stats.

The response to the DOJ statement of interest said the government is ignoring the effects of the Agri Stats deal, while also seeking to block specific conduct that stopped back in 2019.

The workers are represented by Hagens Berman Sobol Shapiro LLP, Handley Farah & Anderson PLLC, Cohen Milstein Sellers & Toll PLLC, Lockridge Grindal Nauen PLLP, and Berger Montague PC.
