Former nuclear plant workers are asking a Maryland federal court to let them refile a proposed class action, saying they have new, direct evidence that companies worked together to fix wages in the nuclear energy industry.
In a Monday motion seeking leave to file a second amended complaint, a trio of former nuclear plant employees say they have additional evidence to back collusion allegations, including that nuclear energy executives used a third-party email system to covertly discuss employee compensation. The workers argue the new complaint supports that the more than 45 defendants — including Constellation Energy, DTE Energy and Duke Energy — engaged in fraudulent concealment, which would toll a four-year statute of limitations that a Maryland federal judge found barred the proposed class action.
“The new allegations in the [proposed second amended complaint] establish that defendants participating in compensation information exchanges ‘realized that their actions were illegal,'” the motion states.
The new evidence and amended complaint address issues identified by U.S. District Judge Adam B. Abelson, who dismissed most of the lawsuit without prejudice Aug. 5, they added.
The former workers filed a proposed class action in July 2025 alleging that energy companies across the country had unlawfully shared information with one another to suppress wages since 2003. The defendants, in corporate families that include Pacific Gas & Electric, Dominion Energy, Entergy and Southern California Edison, moved to dismiss the complaint, saying it relied on normal information-sharing practices and public data.
