March 27, 2024

Harini Srinivasan, an associate in our Civil Rights & Employment practice, has been invited to speak on a Strafford webinar panel that will delve into the current state of FLSA collective action certification in light of the recent Swales and Clark appellate decisions.

The Strafford webinar, “FLSA Collective Action Certification: Appellate Decisions Eroding the Lusardi Two-Step Process, Creating Circuit Split,” is scheduled for Wednesday, March 27, 2024 | 1:00pm-2:30pm EDT.

Panelist from both the plaintiff and defense bar will explore various critical considerations:

  • How do the standards established in Swales and Clark have an impact upon litigation strategy for plaintiff and defense counsel, including burdens of proof that must be met, timing and extent of discovery, and motion practice?
  • What effect have those decisions had on jurisprudence in other circuits?
  • What impact might these decisions have on where and how to bring FLSA collective actions?
  • What are the best practices for plaintiff and defense counsel when litigating FLSA collective actions in the affected jurisdictions?
