The four companies controlling roughly 98% of the frozen potato product market must face consumers’ accusations that they shared competitively sensitive information and coordinated other efforts to carry out an illegal price-fixing scheme, an Illinois federal judge has ruled.
U.S. District Judge Jeremy Daniel trimmed only some state law claims from the proposed classes’ consolidated complaint and said Thursday the consumers have plausibly outlined an illegal conspiracy through which Lamb Weston Holdings Inc., McCain Foods, J.R. Simplot Co. and Cavendish Farms Ltd. manipulated hash brown, tater tot and other frozen potato product prices in violation of the Sherman Act.
