WASHINGTON, DC— Veteran litigator Dan McCuaig has joined Cohen Milstein’s Washington, DC office as a Partner in the firm’s Antitrust practice. Prior to joining Cohen Milstein, McCuaig was a Trial Attorney in the Antitrust Division at the U.S. Department of Justice for more than a decade, where he led investigation and litigation teams in both criminal and civil matters related to price-fixing, bid-rigging, collusion, and other antitrust claims. McCuaig played a key part in the Justice Department’s successful trial to block the Anthem/Cigna merger, and led the e-book price-fixing investigation against Apple and five major publishers. McCuaig played a lead role in negotiating settlements with each of the publishers in advance of trial, and in prevailing over Apple in SDNY and the Second Circuit. The case ultimately resulted in settlements that provided $400 million in consumer relief.

Prior to joining the Justice Department, McCuaig was counsel at WilmerHale, where he focused on civil antitrust defense work and litigating telecommunications disputes before state public service commissions, the FCC, and state and federal courts. He also counseled business entities on their privacy and data security obligations.
McCuaig is the co-author of Telecommunications Convergence Overview and the author of Halve the Baby: An Obvious Solution to the Troubling Use of Trademarks as Metatags.
McCuaig received his B.A., summa cum laude, from The George Washington University, and his J.D., cum laude, from Harvard Law School, where he was a Senior Editor and the Treasurer of the Harvard Negotiation Law Review. He was a judicial clerk to The Honorable Algenon L. Marbley of the United States District Court for the Southern District of Ohio in Columbus.
