Mr. Sommers responded to the Eighth Circuit's April ruling which overturned the certification of a class of Best Buy Co. Inc. shareholders, the first ruling by a circuit court to apply the Supreme Court's closely watched 2014 Halliburton ruling. Mr. Sommers said that the significance of the case is likely to be limited, given the narrow set of facts that led the Eighth Circuit to overturn class certification.

"It was a unique set of facts that are unlikely to be replicated in future cases."
