Amid continued concern over GenX and its presence in the Cape Fear River – the main drinking water source for Wilmington and surrounding areas – a consolidated class action alleges that DuPont and former wholly-owned subsidiary Chemours (NYSE: CC) disregarded tests and illegally dumped the chemical. 

The complaint was filed late Wednesday by newly appointed co-lead counsel for the class Cohen Milstein Sellers & Toll and Susman Godfrey.


The complaint accused the company of executing those practices in order to avoid costs associated with discharging the chemical safely. 

Aside from the traditional means of water contamination, Cohen Milstein notes that independent research suggests that GenX may be airborne as well.
