Investigation of Windstream Retiree Health Benefits

On December 23, 2009, Windstream Corporation (“Windstream”) filed suit seeking a Declaratory Judgment that it has the right to terminate or modify the retiree medical and other health benefits provided to its retirees through the Windstream Comprehensive Plan of Group Insurance (“the Windstream Plan”). Cohen Milstein is currently investigating whether Windstream is permitted to make those changes.
Retirees Affected By These Changes
It is our understanding that employees (both salaried and union employees) who retired from the following companies are currently receiving retiree health benefits from the Windstream Plan: (1) Valor Telecommunications of Texas, LP; (2) Alltel; (3) Mid-Continent; (4) SLT Communications, Inc., (5) Aliant Communications; (6) Concord Telephone Company; (7) Western Reserve Telephone Company; and (8) Kerrville Telephone Company, LP.
The Windstream Plan provides benefits through the Windstream Dental Care Plan, the Windstream Exclusive Provider Option Plan, the Windstream Health Maintenance Organization Plan, the Windstream Preferred Provider Organization Plan and the Windstream Health Reimbursement Account Plan.
