Cohen Milstein is chair of the Executive Committee in this case that was brought in 2004 on behalf of direct purchasers of Publication Paper (i.e., Supercalendared Papers and Coated Papers) for alleged violations of the U.S. antitrust laws. The case was recently certified as a class action by Judge Underhill (D. Conn.). Plaintiffs specifically claim that the defendant paper manufacturers participated in a global conspiracy to suppress competition by fixing the prices of, and allocating the markets and sales volumes for, Publication Paper sold in the United States in violation of Section 1 of the Sherman Act. Because of defendants' unlawful conduct, plaintiffs paid artificially high prices for Publication Paper and, as a result, have suffered antitrust injury.
