On January 12, 2009, Cohen Milstein Sellers & Toll filed a complaint on behalf of several plaintiffs and a proposed class of purchasers of Netflix’s on-line DVD rental subscriptions who allege that Netflix and Wal-Mart conspired to allocate the markets for on-line DVD rentals and for DVD sales in the U.S. The purpose and effect of this conspiracy was to monopolize and unreasonably restrain trade in the online DVD rental market. The class period is from May 19, 2005 to the present.
