Cohen Milstein was one of the Lead Counsel for the Plaintiffs and Class in the lawsuit against Direct Merchants Credit Card Bank, N.A. The case alleged that Direct Merchants engaged in overly-aggressive and unlawful business practices to cardholders nationwide, including charging unwarranted late fees, charging clients for credit card products they did not want or approve, and other practices. The action was settled, providing for certain free products, services or benefits to former cardholders; for current cardholders, the settlement offers participation in a Customer Satisfaction Guarantee Program that will provide up to $70 in monetary credits to resolve current cardholders’ complaints. By the settlement, Direct Merchants also agreed to change a number of its business practices and certain of its processes related to receipt and credit of customers’ payments, designed specifically to avoid certain of the problems alleged in the Complaint.
